Terms of Service
Introduction
These Terms govern your use of PollSpark. By creating an account or using the service, you agree to these Terms.
If PollSpark is purchased personally, the individual purchaser is the customer. If it is purchased by an authorised person on behalf of an organisation, the organisation is the customer and the purchaser confirms that they have authority to bind it to these Terms. The PollSpark Team owner remains the account and billing administrator but is not necessarily the legal customer.
The service
PollSpark is a live polling and survey platform that enables users to create and run interactive sessions with participants. Features and usage limits vary by subscription tier. Current details are available at pollspark.co.uk/pricing.
Your account
You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information when registering. You must not share your credentials with people not covered by your licence.
Subscriptions and billing
Free accounts include Live and Survey, sharing 50 participant slots in each allowance period, access to results for 60 days and watermarked PDF exports. The Live session that uses the final included slot may continue up to 60 participants. This continuation does not apply to Survey. No payment is required.
Paid plans are available at Individual and Teams tiers with expanded features and usage limits. Full details are at pollspark.co.uk/pricing.
Subscriptions are billed in advance. Annual plans are 12-month commitments paid upfront. Monthly commitment plans are 12-month commitments paid monthly. Rolling monthly plans renew month to month.
Rolling monthly subscriptions can be cancelled at any time, with cancellation taking effect at the end of the current billing period. Annual plans and monthly commitment plans cannot be cancelled early through the billing portal during the committed term, except where required by law.
Payment for every paid plan is taken immediately. Paid access begins only after successful payment.
We offer a 14-day money-back guarantee on your first paid PollSpark purchase. A request must reach hello@pollspark.co.uk within 14 calendar days of successful payment. Later purchases don't qualify, including after cancellation, a plan or billing change, or a return after a gap.
The 14-day money-back guarantee ends once you run a counted live session. A live session counts when a third unique participant genuinely participates. Waiting-room joins, the first two unique participants, duplicate participation, and leaving and rejoining with the same participant identity do not count. Team owner and accepted-member usage is pooled against the purchasing owner.
Refund requests are reviewed manually. If approved, we will issue the refund and end the associated paid entitlement. For an annual commitment paid monthly, this means refunding the first instalment and ending the remaining commitment as part of the approved outcome.
We will give at least 30 days notice of any price changes by email and on the pricing page. Changes take effect at your next renewal date.
The 14-day money-back guarantee is separate from your statutory rights. Nothing in these Terms limits or replaces rights that apply under consumer law.
Your content
You retain full ownership of all session content you create, including questions, response options and exported results. You grant us a limited licence to store and process that content for the purpose of providing the service to you. We make no claim to your data.
When you delete a session, PollSpark deletes that session and its participant response data from the active service. Residual copies may remain temporarily in backups or provider systems until they expire under their normal retention processes.
Data and compliance
The customer or relevant organisation is the data controller for participant or session personal data it chooses to collect through PollSpark and is responsible for complying with applicable data-protection law. PollSpark processes that content on the controller's behalf as a data processor.
PollSpark separately acts as data controller for technical and operational data processed for its own purposes, including billing, security, service operation and platform administration. Our Privacy Notice explains these roles and how personal data is handled.
Acceptable use
You must use the service in accordance with our Acceptable Use Policy, available at pollspark.co.uk/acceptable-use.
Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We will give reasonable advance notice of planned maintenance. Urgent security issues may require immediate action without prior notice.
Cancellation and termination
You may stop renewal according to the billing option you selected. Rolling monthly plans can be cancelled at the end of the current monthly billing period. Annual and 12-month monthly commitment plans continue until the end of the committed term. No refund is issued for unused time except where required by law.
Cancelling a paid subscription is not the same as closing a PollSpark account. Cancellation does not start account-data deletion. The account remains open unless the customer explicitly asks us to close it.
We may suspend or terminate access immediately if these Terms or the Acceptable Use Policy are breached. We may terminate for any other reason with 30 days notice.
A verified explicit request to close an account starts PollSpark's manual closure process. Ordinary account and session data will be removed from the active service as soon as safely practical and within 90 days. Limited technical records and billing, payment, refund, fraud, security, legal and similar evidence may remain for the separate periods that apply to them.
Limitation of liability
To the extent permitted by law, PollSpark shall not be liable for indirect, consequential or loss of profit arising from your use of the service. Our total liability shall not exceed the amount you paid in the 12 months before the claim arose. Nothing in these Terms limits liability for death, personal injury or fraud.
Governing law
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
