Terms of Service
Introduction
These Terms govern your use of PollSpark, provided by PollSpark ("we", "us"). By creating an account or using the service, you agree to these Terms. If you are using PollSpark on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.
The Service
PollSpark is a live polling and survey platform that enables users to create and run interactive sessions with participants. Features and usage limits vary by subscription tier. Current details are available at pollspark.co.uk/pricing.
Your Account
You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information when registering. You must not share your credentials with people not covered by your licence.
Subscriptions and Billing
Free accounts include 50 participant slots per month, 60-day results history and watermarked PDF exports. No payment is required.
Paid plans are available at Individual, Teams and Trust tiers with expanded features and usage limits. Full details are at pollspark.co.uk/pricing.
Subscriptions are billed in advance, either annually or monthly depending on the plan selected. Fees are non-refundable except where required by law.
Teams annual plans include a 30-day free trial. A payment card is required at signup. No charge is taken until day 31. A reminder email is sent on day 25. You may cancel before day 31 at no cost.
We will give at least 30 days notice of any price changes by email and on the pricing page. Changes take effect at your next renewal date.
Individual paid plans are available to consumers. Under UK consumer protection law, you have a 14-day right to cancel a digital service from the date of purchase. By ticking the confirmation box at signup and accessing the service immediately, you acknowledge that you waive this right. This does not affect your right to cancel auto-renewal at any time.
Your Content
You retain full ownership of all session content you create, including questions, response options and exported results. You grant us a limited licence to store and process that content for the purpose of providing the service to you. We make no claim to your data.
Data and Compliance
If you collect personal data from participants through PollSpark, you are the data controller and are responsible for complying with UK GDPR and the Data Protection Act 2018. We process that data on your behalf as a data processor. Our Data Processing Agreement is available on request at pollspark.co.uk/dpa.
Acceptable Use
You must use the service in accordance with our Acceptable Use Policy, available at pollspark.co.uk/acceptable-use.
Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We will give reasonable advance notice of planned maintenance. Urgent security issues may require immediate action without prior notice.
Cancellation and Termination
You may cancel your subscription at any time. Access continues until the end of the current billing period. No refund is issued for unused time.
We may suspend or terminate access immediately if these Terms or the Acceptable Use Policy are breached. We may terminate for any other reason with 30 days notice.
On termination, your data remains accessible for 30 days. Please export anything you need before this period ends. After 30 days, data is permanently deleted.
Limitation of Liability
To the extent permitted by law, PollSpark shall not be liable for indirect, consequential or loss of profit arising from your use of the service. Our total liability shall not exceed the amount you paid in the 12 months before the claim arose. Nothing in these Terms limits liability for death, personal injury or fraud.
Governing Law
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
